If this were me . here is what I would do..

Dr’s Idiot Billing Department

Dear Sir or Madam,

Please forward any and all records in regards to any account or amount you allege is owed by me. Please include itemized account statements, any and all records indicating what insurance was billed and when, any response from the insurance company, any and all financial responsibility agreements, any assignment of benefits, all patient records and a copy of the UB-92 or UB-4 used to bill insurance.

Please find an executed release for the records enclosed.

You can format your own release despite any assertions from them. It needs to have your name, DOB and social, state that you consent for them (specify their name) to release the records to you (your name) at the following address: [address here]. Print and sign your name at the bottom. I would find and send this through the registered agent by certified mail with the return receipt. Although the RA is likely the address of the office, who knows.

At the same time I would write the insurance company requesting any information they have, CM through the RA. Ask them for any information in regards to claims filed by the specific provider where you were the patient including copies of any EOB’s available.

Also see if you can find someone to review the billing information and see if they properly billed. If all else fails email the people at hostpitalvictims.org and ask if they will review it for you. Some errors will be obvious because if they incorrectly billed they would have received something back from the insurance company denying the claims and that document will say why the claim was denied.

IMHO . insurance should cover it if you were insured during that time . period. In contrast, if the provider failed to properly bill then they should have to eat the bill.

So anyway . once you receive all this . if you receive all this . file a complaint with the insurance commissioners office in your state, as others have advised. If you receive no response then file with the insurance commissioner anyway and include copies of your requests.

If the provider fails to cooperate then find out what office in your state licenses doctors and file a complaint there as well, they must give you copies of YOUR records. In GA it is the composite state board of medical examiners.

If it’s an HMO and you have a copy of the referral, immediately file a complaint with your State’s Department of Insurance that regulates HMO’s and PPO’s and let them investigate. I used to work for an HMO and each time we received a Department of Insurance complaint, we had 9 days to resolve the issue or the State would fine us. If you had a PPO at the time, immediately file the Department of Insurance complaint with your State and provide them a copy of the bill since PPO’s do not require a referral. The debt collector should clear your credit report once the bill is paid.

I had back surgery in june of 2002. everything was paid for except the anesthesia. i do a credit report 2007. Come to find out that it never got paid for and it is in collections. So I contact the anesthesiologist office. They send me a letter showing that they made 3 attempts to collect the debt. My question is if I paid the debt could I sue the insurance company for the debt and damages. I have tried calling the insurance company to explain the situation but they tell me that it is to old. Please help.
